Your data will be processed by “Pedro Nuno Correia Freitas”, Sole Proprietor, no. 218 988 338 (hereinafter referred to as Pnstays).
Pnstays is responsible for processing your personal data within the meaning of the General Data Protection Regulation (hereinafter referred to as GDPR).
Why do we process your information?
Your personal data may be collected and processed by Pnstays for the following purposes:
a) To comply with legal obligations to which Pnstays is subject, including communications to the Immigration and Border Service and Invoicing.
b) For the purpose of executing the Temporary Tourist Accommodation Contract or the Local Accommodation Management Contract entered into with Pnstays, including payment transactions, managing check-ins and check-outs, managing guests, blocking deposits, providing complementary services to the stay such as cleaning, transfers, or grocery services, managing contractual obligations, or for pre-contractual arrangements.
c) For the purpose of contact via email, mobile communications, digital platforms, within the scope of Pnstays’ marketing strategies, commercial and contractual information and communications, as well as for information requests.
d) For the purpose of protecting property owned or under the care of Pnstays, as well as for statistical analysis purposes.
Failure to provide personal data for the purposes set out in points a) and b) will result in Pnstays being unable to comply with legal obligations imposed on it and the potential termination of the Temporary Tourist Accommodation Contract or the Local Accommodation Management Contract entered into, without any right to compensation, as well as deficient service provision by Pnstays which cannot be attributed to it.
What type of personal data do we collect?
In the course of its activities, Pnstays will collect and process the personal data necessary for the provision of contracted services, information requests, or pre-contractual management, namely identification, contact, banking, or payment card data.
For what purposes do we process your information?
The processing of your personal data will be carried out based on the execution of the Temporary Tourist Accommodation Contract, the Local Accommodation Management Contract, and the compliance with legal obligations imposed on Pnstays, particularly legislation on the Entry, Stay, and Exit of Foreigners in National Territory and tax legislation (Article 6(1)(b) and (c) of the GDPR).
Additionally, the personal data collected for the purposes outlined in point c) above are based on your consent given to Pnstays for such processing (Article 6(1)(a) of the GDPR).
For the purposes set out in point d) above, Pnstays will process personal data based on its legitimate interest (Article 6(1)(f) of the GDPR).
How long do we keep your information?
Without prejudice to legal, regulatory, or judicial provisions to the contrary, the personal data collected will be retained only for the minimum period necessary for the purposes that motivated their collection or subsequent processing.
To whom may we transmit your personal data?
Pnstays may need to share some of your personal data with other recipients. These recipients include:
a) Organizations and/or companies affiliated with Pnstays, provided they adhere to an equivalent personal data protection policy.
b) Public entities to which Pnstays is legally obliged to provide information, including the Immigration and Border Service and the Directorate General for Taxes.
c) Subcontractors providing certain services related to your personal data under a subcontract and solely for the purpose of providing technical assistance to Pnstays. These include, but are not limited to, website hosting providers, email marketing service providers, cleaning service companies, law firms, accounting firms, and insurance companies.
d) Competent authorities to which Pnstays is legally obliged to disclose information in the course of legal proceedings or to detect technical and/or security issues, such as judicial entities or competent control authorities.
Are my data transferred to countries outside the European Union?
Your personal data collected by Pnstays will not be transferred to any entity established outside the territory of the European Union.
Exceptionally, and under certain conditions, Pnstays may transfer your personal data to countries outside the European Union territory, in accordance with applicable legislation, particularly for data hosting or storage, technical subcontracting of processing, backup and recovery of hosted data, and service development.
Pnstays assures you that it will not transfer your personal data to countries that do not ensure an adequate level of protection, in accordance with the provisions of the GDPR.
What are my rights?
At any time, under the GDPR, you may request access to your personal data, as well as their rectification or deletion, limitation of processing, right to object, and right to data portability.
If the requests made are manifestly unfounded or excessive, particularly due to their repetitive nature, Pnstays may charge a reasonable fee considering the administrative costs of providing the information or communication, or taking the requested measures, or refuse to follow up on the request.
Regarding personal data processed based on consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal, nor the subsequent processing of the same data based on another legal basis, such as the performance of a contract or legal obligation to which Pnstays is subject.
You also have the right to lodge a complaint with the National Data Protection Commission.
Security and Confidentiality
We are committed to keeping your data secure, and therefore we apply appropriate technical and organizational measures to ensure a level of security appropriate to the risk of keeping your personal data on file. However, information transmission over the Internet is not completely secure, and we cannot absolutely guarantee the security of information transmitted through our website.
We also respect the confidentiality of your information. As such, we do not sell, distribute, or otherwise commercially make your information available to third parties. Pnstays is committed to keeping your information confidential in accordance with this Privacy Policy and applicable legislation.
